BY ENTERING THE CONTEST, YOU, (“PARTICIPANT”) AGREE TO THESE OFFICIAL RULES, which form a contract. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITY OBLIGATIONS on the part of Participant and A LIMITATION OF Participant’s RIGHTS AND REMEDIES.

ELIGIBILITY: "Win $500 for Your School" Sweepstakes (“Sweepstakes”) is open only to legal residents of Iowa, Kansas, Minnesota, Nebraska, Wisconsin or Virginia who are eighteen (18) years of age and older at the time of entry. Persons in any of the following categories are NOT eligible to win a prize: (a) employees or agents of Carlos O'Kelly's and their parent companies, subsidiaries, affiliates, advertising and Sweepstakes agencies, (b) individuals engaged in the development, production or distribution of materials for the Sweepstakes; and (c) persons who are in the immediate family of any person in any of the preceding categories (including mother, father, sister, brother, daughter, son, spouse, grandmother, grandfather, children or grandchildren), regardless of where they live; or persons who reside in the same household, whether related or not, as any person in any of the preceding categories. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited or restricted by law. By entering the Sweepstakes, Participants agree to abide by and be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final and binding in all respects.

PROMOTION PERIOD: The Sweepstakes begins at 12:01 AM Central Time on September 5, 2017, and ends at 11:59 PM Central Time on September 30, 2017 (“Promotion Period”). Administrator’s computer is the official time-keeping device of the sweepstakes.

HOW TO ENTER:

To enter online: Enter online at at https://www.facebook.com/carlosokellys. You do not need a Facebook Account in order to enter the sweepstakes. To enter the Sweepstakes during the Promotion Period, you must provide your name, email address, school name, school location and school level. Only schools located in Iowa, Kansas, Minnesota, Nebraska, Wisconsin or Virginia and within 50 miles of a Carlos O'Kelly's restaurant may be nominated. There will be a limit of three (3) entries per person each 24 hours during the promotion period. Multiple Participants are not permitted to share the same email address. Any attempt by any Participant to obtain more than the stated number of entries by using multiple/different profiles, identities, registrations and logins, or any other methods will void that Participant’s entry and that Participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification.

To enter by mail: On a 3"x 5" card, hand print your name, email address, school name, school location and school level, and a statement that you are of the age of majority in your state of residence, and mail in a first class stamped envelope to: "Win $500 for Your School" Sweepstakes, c/o Sasnak Management Corporation, 1877 North Rock Road, Wichita, KS 67206. Envelopes must be postmarked by September 30, 2017, and received before 12pm Central Time on October 5, 2017. Participants that submit an entry via mail are subject to all entry limitations specified above. Sponsor and its agencies will not be responsible for incomplete, illegible, lost, late, postage-due, misdirected or mutilated entries.

WINNER SELECTION: Administrator will select three winners in a random drawing after 12pm Central Time on October 5, 2017. There will be one winner from all elementary school nominations received, one winner from all middle school nominations received, and one winner from all high school nominations received. Winners will be notified by email and each of the three schools selected in the drawing will be contacted by telephone and/or email within 72 hours of selection. An official representative of each school must reply to the email or phone notification within seven (7) days and confirm agreement to any terms stated in the email before their donation can be awarded. If Administrator is unable to contact a any of the three schools within a reasonable time period, or if prize or prize notification is returned as undeliverable, or winner is not in compliance with these Official Rules, the prize will be forfeited and, in Administrator’s discretion, an alternate winner may be selected.

Winners and potential winners must continue to comply with all terms and conditions of these Official Rules; and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Administrator will award the applicable prize to an alternate winner from among all remaining eligible entries. The prize will be fulfilled approximately seven (7) days after email confirmation is received from potential winner, although no specific time frame for fulfillment is guaranteed by Administrator.

PRIZES: Three prizes will be awarded. Each prize awarded will consist of a $500 donation to the winner's nominated school. The total Approximate Retail Value (ARV) of the prize is $500. Total ARV of all prizes is $1,500. The ARV is as of the date of printing of these Official Rules. The difference in value of prize as stated herein and value of at time of prize notification, if any, will not be awarded. Limit one prize per household. The prizes are not transferable and cannot be assigned or substituted except at the sole discretion of Administrator.

Administrator reserves the right to substitute a prize of equal or greater value in the event that a stated prize cannot be awarded for any reason.

FACEBOOK DISCLAIMER: This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Facebook. By participating in this Sweepstakes, you hereby release Facebook from any claim, allegation, loss or liability of any kind.

RELEASE: By entering the Contest, Participant does hereby release, indemnify and hold harmless Sponsor, Administrator, Facebook and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize. Entry into this Contest and acceptance of prize constitutes permission for Sponsor to use a winner’s first name and first initial of last name and state of residence, for advertising/trade and all other purposes, in any and all media, and all media now or hereafter known worldwide, including the Internet and social networking sites, without further compensation, notification or permission, unless prohibited by law.

PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes Participant’s consent to Administrator, Sponsor and their agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

GENERAL CONDITIONS: Administrator reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Administrator’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Administrator in its sole discretion. Administrator reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an Participant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, provided that, if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Administrator, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Administrator reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

DISPUTES: Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Kansas or Kansas state court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased and consent to the exclusive jurisdiction of the courts of Kansas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Administrator in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Kansas without giving effect to any choice of law or conflict of law rules (whether of the State of Kansas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Kansas.

PARTICIPANT’S PERSONAL INFORMATION: Administrator’s use of information submitted as part of the Sweepstakes will be limited to administering and conducting the Sweepstakes. Administrator will not use any information submitted for any other purpose.

WINNERS’ LIST: Winners’ first names and first initial of last name will be posted on the Carlos O'Kelly's Facebook page at the conclusion of the Sweepstakes.

MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. When terms such as "may" are used in these Official Rules, Sponsor has sole and absolute discretion. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on the Website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
